According to documents found by XDA detailing the proceedings of the Micromax v. OnePlus lawsuit in India - resulting in the barring of sale of the latter's phone there - the falling out between Cyanogen and OnePlus was far uglier than previously reported, but probably as ugly as some of us imagined.

A series of emails between Cyanogen Inc. CEO Kirt McMaster and OnePlus Global Director Carl Pei were revealed as part of discovery in the proceedings, and they show a less than amicable relationship was evolving between the two as the Micromax deal finalized.

If OnePlus is good at anything, it's building hype. We experienced months of that early this year during the lead up to the OnePlus One announcement. The company started playing up a "Go Further" announcement the other day for 12/17. Well, here we are and guess what... it's a battery. An external battery with USB ports and stuff called the OnePlus Power Bank. Oh.

The dust has barely settled after the bombshell announcement that Cyanogen Inc. quietly signed an exclusive deal with OEM Micromax in India. That left the OnePlus One with an uncertain future in India without a software partner, and now things are getting even worse. The OnePlus One has been banned in India after legal action by Micromax.

It's been a long and winding road to find the truth behind the recent announcement that Cyanogen Inc. had signed an exclusive deal with Micromax in India. OnePlus made waves when it said that meant there would be no CM updates for the OnePlus One sold in India, but Cyanogen Inc. made a blog post saying all global devices would get updates, and all was well. As a "new" company that caters almost exclusively to technology enthusiasts, OnePlus has been under the microscope ever since it announced its One flagship phone... with no small amount of criticism coming from this very website. But a string of recent posts on the official OnePlus forums prompted a response from the company's social team. Basically, customers accused OnePlus of shipping refurbished One phones and claiming they were new, a practice that isn't unheard of from consumer goods manufacturers and retailers of all sizes.

Update: OnePlus claims the Indian version of the OnePlus One will ship with CyanogenMod. However, OnePlus plans to eventually shift as many Indian OPO owners as possible to the company's own Android ROM early next year, though the OPO will continue to receive worldwide support from CyanogenMod for the time being.

Update 2: Cyanogen Inc. has clarified how updates will work. If a device is shipped with CM, it gets updates even if it's sold in India.

The OnePlus One isn't quite the hot item it used to be, and if there are any prospective buyers in India, they might have been swayed by the handful of flagship phones that have launched from more conventional manufacturers in the months since the device's release. Even so, if you want a One on the subcontinent, you won't have too much longer to wait. Maybe. According to this promotional page and some information from the OnePlus forum, Amazon will start selling the One in December.

Since launch, some OnePlus One owners have encountered issues with the phone's touchscreen. The complaints center around the display being unresponsive, causing it to miss certain touches and provide a generally frustrating typing experience. Sometimes it resulted in taps while dragging or swiping.

Now a firmware upgrade is in testing that takes care of this problem entirely. It's expected to go out to users soon in an upcoming over-the-air update.
