After winning multiple preliminary injunctions against Samsung's Galaxy Tab family (including the 10.1, 8.9, and 7.7) in Germany in the recent past, Apple is looking to add one more device to the list: Samsung's Galaxy Tab 10.1N.

For those who don't know, the Galaxy Tab 10.1N is exactly the same as the original 10.1, except that it has a new form factor, adding a silver bezel and repositioning the tab's speaker grills.

Despite the fact that Samsung created the new design while closely collaborating with their German lawyers, Apple seems to think the redesign didn't go quite far enough. The Cupertino giant has filed a motion for preliminary injunction on the 10.1N, and the Düsseldorf Regional Court has planned a hearing for December 22, 2011.


While this may sound like a simple anti-competitive jab at first blush, FOSS Patents argues that Apple's motion against the 10.1N will help clarify "what falls within the scope of its exclusive rights and what doesn't." On the other hand, releasing the redesigned Tab may have been a "calculated risk" on Samsung's part, done to gain the same insight.

Making the situation even stickier, the hearing regarding the 10.1N falls a mere two days after Düsseldorf's Higher Regional Court hears Samsung's appeal to the original 10.1 injunction. The results of the latter are almost certain to have an effect on the former. The results of both hearings are unpredictable at this point, but we'll be here to report on any new details that roll out.

      The thing is, Apple isn't "for" competition - they'll try any means they can to eliminate it, ethical or not. They aren't doing this because they think people are gonna mistake a tablet - they're doing it because they perceive a threat to the iPad.

      This is just a mean move for Samsung not to be able to ship their next tab. Meanwhile, the iPad3 is lurking for the early 2012 release.

    Apple has become an absolute joke of a company and they simply hate being made a fool of. Apple is just butthurt they have no real innovation or creativity anymore so their only option is to be all sue-happy.

    here we go again, wouldn't it be more productive for Apple to spend more effort on the next iteration of your products rather than pursue these headache-inducing lawsuits then again, the legal team must be craving a truly sweet Xmas bonus. Ironically funny though, Apple still wants to consider Samsung for displays to their products.

      Because they know Samsung can make a good tablet and nice phones too. Of all Android tablets, the Samsung Galaxy series has some of the best ones. They are scared of them as competition. And being Apple, Apple wants to either destroy them or hinder their growth and sales.

    The behaviour of my fellow-german judges has been nothing but embarassing so far in that matter. I'm not sure that's going to change soon.

    I certainly wish for less awkward rulings in the future.
